Array36 Terms and Conditions
Welcome to Array 36 ("we," "us," or "our"). By dining with us, making a reservation, placing an order, or using our services (including online ordering or delivery), you agree to be bound by the following Terms and Conditions ("Terms"). Please read them carefully.
1. Reservations and Cancellations
1.1 Reservations: We encourage reservations to guarantee seating. Walk-ins are accommodated based on availability. Reservations can be made via our website, phone, or third-party platforms (where applicable).
1.2 Cancellation Policy: Please notify us at least 24 hours in advance if you need to cancel a reservation. Failure to show up ("no-show") or late cancellations may result in a fee of $100 or restrictions on future bookings for large parties.
1.3 Large Parties: Groups of 8 or more may require a deposit to secure the booking. Deposits are refundable only if cancellations are made within the specified period.
2. Dining Policies
2.1 Dress Code: We maintain a casual/business casual/smart casual dress code. Guests may be refused entry if attire is deemed inappropriate (e.g., beachwear, offensive slogans).
2.2 Conduct: We reserve the right to refuse service or ask guests to leave if their behavior is disruptive, offensive, or violates health and safety standards.
2.3 Allergies and Dietary Restrictions: Please inform us of any allergies or dietary restrictions when ordering. While we take precautions, we cannot guarantee a completely allergen-free environment due to shared kitchen spaces.
2.4 Children: Children are welcome but must be supervised at all times. High chairs are available upon request, subject to availability.
2.5 Outside Food and Beverages: Outside food and beverages are not permitted, except for special circumstances (e.g., birthday cakes) with prior approval.
3. Payment and Pricing
3.1 Menu Prices: All prices are listed in USD and are subject to change without notice. Prices exclude applicable taxes and service charges unless otherwise stated.
3.2 Service Charge: A 15% service charge may be added to your bill. This is not a gratuity and is used to support our staff and operations.
3.3 Accepted Payment Methods: We accept cash, credit/debit cards, mobile payments. Checks are not accepted unless pre-arranged.
3.4 Split Bills: For parties of 8 or more, we may limit the number of split bills to ensure efficient service.
3.5 Refunds: Refunds for food or beverage items are issued at our discretion, typically only in cases of incorrect orders or quality issues reported during your visit.
4. Online Ordering and Delivery
4.1 Order Accuracy: We strive to fulfill orders accurately. Please review your order before submission. Errors must be reported within 24 hours of receipt for correction or refund consideration.
4.2 Delivery: Delivery times are estimates and may vary due to traffic, weather, or demand. We are not liable for delays beyond our control.
4.3 Third-Party Delivery: When ordering through third-party platforms, their terms and conditions also apply. We are not responsible for issues caused by third-party services.
5. Promotions and Discounts
5.1 Eligibility: Promotions and discounts are subject to availability and may have specific conditions (e.g., dine-in only, minimum spend).
5.2 Non-Combinable Offers: Discounts cannot be combined with other offers unless explicitly stated.
5.3 Expiration: Promotions are valid only during the advertised period and may be discontinued without notice.
6. Health and Safety
6.1 Food Safety: We adhere to local food safety regulations. Raw or undercooked items (e.g., sushi, steak) are served at your own risk, as noted on the menu.
6.2 Health Protocols: We follow local health guidelines (e.g., sanitation, capacity limits). Guests may be required to comply with measures such as temperature checks or providing contact information for tracing purposes.
6.3 Liability: We are not liable for foodborne illnesses unless directly caused by our negligence.
7. Intellectual Property
7.1 Photography: By dining with us, you consent to photography or video recording for promotional purposes. If you prefer not to be featured, please inform us.
7.2 Trademarks: Our logos, menus, and branding are our property and may not be used without written permission.
8. Limitation of Liability
8.1 General: We are not liable for any loss, damage, or injury sustained on our premises unless caused by our gross negligence or willful misconduct.
8.2 Personal Belongings: Guests are responsible for their personal belongings. We are not liable for lost or stolen items.
8.3 Force Majeure: We are not responsible for failure to perform services due to events beyond our control (e.g., natural disasters, government orders).
9. Privacy
9.1 Data Collection: We collect personal information (e.g., name, contact details) for reservations, orders, or marketing purposes. This data is handled per our Privacy Policy.
9.2 Third Parties: We do not share your data with third parties except as required by law or for operational purposes (e.g., delivery services).
10. Governing Law and Dispute Resolution
10.1 Jurisdiction: These Terms are governed by the laws of California/United States]. Disputes will be resolved in the courts of San Gabriel/CA.
10.2 Mediation: We encourage resolving disputes through mediation before legal action.
